Proposed ADA Changes Promise Federal Regulation of Websites

Have you ever noticed how every shopping mall or government building in America has nearby accessible parking spaces that look remarkably similar? Or how sidewalks throughout America now have curb cuts that also seem very much alike? For the last twenty years, the Americans with Disabilities Act (ADA) has required private businesses and state and local governments to make their facilities accessible according to a very precise set of standards—or face Federal investigations and lawsuits. At long last, the Federal government has started the process to do the same thing to the Internet.

On Friday, July 23, 2010, the United States Department of Justice issued an Advance Notice of Proposed Rulemaking (ANPRM) to help inform the Department on new regulations clarifying how the Americans with Disabilities Act (ADA) should apply to the internet and websites (http://www.ada.gov/anprm2010.htm).

Once the regulations are issued, they are likely to have a profound impact on private businesses and state and local governments. If these regulations mirror the accessibility standards for buildings (which is the closest analogy), then all new or altered web content would be required to meet very stringent accessibility standards as soon as the content is posted. New regulations would also clarify the yardstick that private advocates and the Department of Justice will apply to both private business and public sector websites.
